Lahore High Court Dismisses Intra Court Appeal For Cancellation Of MQM Registration

A Lahore High Court (LHC) division bench has dismissed an intra court appeal (ICA) seeking directions to cancel registration of Muttahida Qaumi Movement (MQM) with the Election Commission. The bench headed by Justice Atir Mahmood heard the petition filed by Ali Javed Dogar, a leader of Pakistan Tehreek-e-Insaf Youth Wing.

Earlier, the petitioner’s counsel Shiraz Zaka submitted that after press conference of Mustafa Kamal and Anees Qaim Khani, it had been proved that the MQM was involved in anti-state activities. He contended that under Section 15 of the Political Parties Order, a political party involved in anti-state activities could not be registered. He submitted that federal government was empowered to send a reference against such a party to the Supreme Court, whereas the Election Commission could also cancel registration of such a party.

He pointed out that a LHC single bench had dismissed the petition on the subject. He pleaded the bench to set aside the single bench verdict and direct the federal government for filing a reference against the MQM in the Supreme Court and also direct the commission for cancelling registration of the MQM. 

However, the bench dismissed the ICA on basis of disputed questions of fact.
